Property offer and sale agreement checklist
Key written terms to confirm before making an offer or signing a sale and purchase agreement.
A serious offer should identify the buyer and seller, the exact property, price, booking or deposit amount, financing condition, lawyer or authorised representative, deadline and the items included in the sale. Confirm whether the seller has authority to sell and whether an agent is authorised to receive money or sign documents.
Ask about tenure, title or lot details, restrictions, existing charges, caveats, outstanding rates, maintenance fees, tenancy, defects and approvals for extensions or renovations. The sale documents should set out payment milestones, completion period, vacant possession, apportionment of charges, transfer costs and remedies if either party does not complete.
Do not rely on a screenshot, listing post or verbal explanation for legal status. Keep every offer, receipt, bank record and written condition. Make payments only through the documented process advised by the appointed professionals.
Before signing, read the complete document and obtain independent legal, financing and valuation advice appropriate to the transaction. A guide cannot confirm ownership, title validity, financing eligibility or legal consequences for an individual purchase.
